1. Acceptance of Terms

By accessing or using AutoTalent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AutoTalent is an AI-powered recruiting automation platform that helps organizations source, score, and contact potential candidates for open roles. The Service includes candidate sourcing, AI-based candidate scoring, email outreach, and pipeline management.

3. Account Registration

You must create an account and provide accurate information to use the Service. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the authority to bind your organization to these terms.

4. Acceptable Use

You agree to use AutoTalent only for legitimate recruiting purposes. You will not:

• Send spam, misleading, or deceptive outreach messages
• Use the Service to harass, intimidate, or discriminate against candidates
• Violate any applicable laws, including CAN-SPAM, GDPR, or other privacy regulations
• Attempt to circumvent usage limits or billing controls
• Resell or redistribute the Service without authorization
• Use the Service to collect data for purposes other than recruiting
• Attempt to reverse engineer, decompile, or extract source code from the Service

5. Email Outreach Responsibilities

When using AutoTalent to send outreach emails, you are the sender of record. You are responsible for:

• Ensuring your outreach complies with CAN-SPAM, GDPR, and applicable anti-spam laws
• Honoring unsubscribe requests promptly
• Providing accurate sender identification
• Using outreach for legitimate recruiting purposes only

When you connect your own email account (SMTP or Google OAuth), emails are sent from your infrastructure. AutoTalent acts as your agent in composing and sending these messages.

6. AI-Generated Content

AutoTalent uses artificial intelligence to score candidates and generate outreach email content. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all AI-generated emails before sending them. AutoTalent is not liable for the content of messages you choose to send.

7. Candidate Data

AutoTalent processes publicly available professional information to help you identify and evaluate candidates. You acknowledge that:

• Candidate data is sourced from public profiles and third-party data providers
• Data accuracy depends on the quality of public sources
• You are responsible for how you use candidate information obtained through the Service
• You will comply with applicable data protection laws when handling candidate data

8. Billing & Payments

Paid plans are billed monthly through Stripe. Usage limits are enforced per billing period. You agree to pay all fees associated with your selected plan. We reserve the right to modify pricing with 30 days notice. Refunds are handled on a case-by-case basis.

9. Intellectual Property

AutoTalent and its original content, features, and functionality are owned by AutoTalent and are protected by copyright, trademark, and other intellectual property laws. Your data remains yours — we claim no ownership over candidate data or content you create through the Service.

10. Limitation of Liability

AutoTalent is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your account at any time through the billing settings. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period to comply with legal obligations.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
